About this store

The data controller for personal information collected through this website is Samanvika Limited, company number 16921179, registered office 36 Abercorn Crescent, Harrow, HA2 0PT.

7th Heaven Foods Limited is also responsible for your information for its own purposes, as explained in section 2 below.

1. About this policy

This policy explains how your personal information is collected and used when you visit www.7thheavenbakery.co.uk or the online store of any 7th Heaven store on a sub-domain of it (for example stanmore.7thheavenbakery.co.uk), when you place an order, and when you contact us by email, phone or WhatsApp. It should be read with our Terms & Conditions.

2. Who is responsible for your information

7th Heaven is a franchise network. Each 7th Heaven store (a "Store") is independently owned and operated by its own franchisee company. Two organisations are responsible for your information, each for its own purposes:

  • 7th Heaven Foods Limited (company number 16002019, registered office 10-13 Lovat Lane, London EC3R 8DN, England) operates these websites, receives payment for orders as agent for the Store, provides general customer service, and sends marketing where you have agreed to it.
  • The Store you order from receives your order details so that it can prepare and hand over or deliver your order, and deal with any changes, cancellations, refunds or complaints about it. The Store's details are shown on its online store and in your order confirmation.

In this policy, "we", "us" and "our" mean 7th Heaven Foods Limited and the Store, as relevant. You can send any privacy question or request to cs@7thheavenuk.com, and we will make sure it reaches the right organisation.

3. The information we collect

  • Contact and order details: your name, email address, phone number, billing and delivery address, what you order, your chosen collection or delivery time, and any message you ask us to write on your cake.
  • Images and designs you send us: for example a photo for a photo cake or a reference design.
  • Payment information: payments are processed by our payment providers. We receive confirmation of payment and limited card details (such as the card type and last four digits), not your full card number.
  • Allergy or dietary information: only if you choose to tell us, for example in an order note or a message.
  • Messages and calls: what you tell us when you email, call or WhatsApp us.
  • Account details: if you create an account, your login details and order history.
  • Your postcode or location: when you use the store finder. A postcode you type is sent to a postcode lookup service (postcodes.io) to find its location. If you choose "Use current location", your device's location is used in your browser to find your nearest Store.
  • Device and usage information: such as your IP address, browser and device type, and the pages you visit, collected through cookies and similar technologies (see section 8).

4. How we use your information and our legal basis

  • To take, prepare and hand over or deliver your order, including contacting you about it. Legal basis: performing our contract with you.
  • To take payment and prevent fraud. Legal basis: performing our contract with you, and our legitimate interest in preventing fraud.
  • To deal with changes, cancellations, refunds, complaints and other requests. Legal basis: performing our contract with you, and our legitimate interest in providing good customer service.
  • To take account of allergy or dietary information you give us. Because this may be health information, we only use it with your explicit consent and only for your order. You can withdraw your consent at any time.
  • To send you news and offers by email or SMS. Legal basis: your consent, or, if you have bought from us before, similar products and services with the option to opt out in every message. You can unsubscribe at any time.
  • To understand how our websites are used and to show you relevant advertising, using analytics and advertising cookies. Legal basis: your consent (see section 8).
  • To keep records we are required to keep, for example for tax and accounting. Legal basis: legal obligation.
  • To run, secure and improve our websites and business. Legal basis: our legitimate interests, balanced against your rights.

5. Who we share your information with

  • The Store that prepares your order, and 7th Heaven Foods Limited, as described in section 2.
  • Shopify, which hosts our websites and processes orders and payments for us, and other payment providers you choose at checkout (such as Apple Pay or Amazon Pay).
  • Service providers that help us run the websites, for example apps for product options, image uploads, collection scheduling and displaying reviews and social media content, and the postcode lookup service.
  • Delivery partners, where a Store offers delivery.
  • Advertising and analytics providers such as Google and Meta, only where you have accepted the relevant cookies.
  • Professional advisers (such as accountants and lawyers), and authorities where the law requires it.
  • A buyer or new operator, if a Store or our business is sold or transferred.

We do not sell your personal information.

6. Transfers outside the UK

Some of our service providers, including Shopify, process information outside the UK, for example in Canada, the European Economic Area or the United States. Where this happens, we rely on UK adequacy regulations or other safeguards approved under UK law, such as the UK International Data Transfer Agreement or Addendum, or the UK Extension to the EU-US Data Privacy Framework.

7. How long we keep your information

  • Order and payment records: 6 years after the order, as required for tax and accounting.
  • Customer service messages and complaints: up to 2 years after the matter is closed.
  • Images and designs you send us: up to 90 days after your order.
  • Allergy or dietary information: only as long as needed for your order.
  • Account details: until you close your account.
  • Marketing preferences: until you unsubscribe. We keep a record that you unsubscribed so that we do not contact you again.

8. Cookies

We use cookies that are essential for the websites to work, such as keeping items in your basket. With your consent, we also use analytics and advertising cookies, including from Google and Meta, to understand how the websites are used and to show you relevant adverts. You can accept or refuse non-essential cookies through our cookie settings, and you can also control cookies through your browser settings.

9. Your rights

You have the right to: ask for a copy of your information; ask us to correct it; ask us to delete it; ask us to restrict how we use it; object to how we use it, including at any time to direct marketing; ask for your information in a portable format; and withdraw any consent you have given. To make a request, email cs@7thheavenuk.com. We will respond within one month, and there is normally no charge.

If you are unhappy with how we have handled your information, please contact us first. You also have the right to complain to the Information Commissioner's Office (ICO) at ico.org.uk or on 0303 123 1113.

10. Keeping your information secure

We use appropriate technical and organisational measures to protect your information. Payments are processed securely by our payment providers. No method of sending information over the internet is completely secure, but we work to protect your information and to act quickly if anything goes wrong.

11. Children

You must be 18 or over to place an order. Our websites are not intended for children under 13, and we do not knowingly collect their information.

12. Changes to this policy

We may update this policy from time to time. The date of the latest version is shown at the bottom of this page.
